These Terms of Service ("Terms") govern your access to and use of the FacilitiesHire website and directory service (the "Service"). By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
FacilitiesHire operates as a directory service connecting customers with portable facilities suppliers. We are not a supplier ourselves and do not provide portable toilets, kitchen pods, or bathroom pods directly.
1. Acceptance of Terms
By accessing or using FacilitiesHire, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users, including customers seeking portable facilities and suppliers listing their services.
We reserve the right to update or modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
FacilitiesHire is an online directory and lead generation platform that:
- • Connects customers with verified portable facilities suppliers across the UK
- • Provides a searchable database of supplier profiles, services, and contact information
- • Facilitates quote requests and enquiries between customers and suppliers
- • Displays supplier reviews and ratings from verified customers
We are an intermediary platform only. All contracts for services are formed directly between customers and suppliers. FacilitiesHire is not a party to these contracts and bears no responsibility for their performance.
3. User Accounts
Suppliers wishing to list their business must create an account. You are responsible for:
- • Maintaining the confidentiality of your account credentials
- • All activities that occur under your account
- • Notifying us immediately of any unauthorised access
- • Providing accurate and up-to-date information
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Supplier Listings
Listing Requirements
To list your business on FacilitiesHire, you must:
- • Be a UK-registered business
- • Hold valid public liability insurance (minimum £5 million)
- • Possess appropriate licences (e.g., Environment Agency waste carrier licence)
- • Have minimum 1 year trading history
- • Provide accurate business and service information
Listing Content
Suppliers are responsible for all content in their listings, including descriptions, photos, pricing, and availability. You must:
- • Provide truthful and accurate information
- • Use only photos of your own equipment
- • Keep pricing and availability up to date
- • Comply with all applicable laws and regulations
We reserve the right to remove or modify listings that violate these Terms or community standards.
5. Quotes and Bookings
Quote Requests
When you submit a quote request:
- • We share your information with relevant suppliers
- • Suppliers contact you directly with quotes
- • You are under no obligation to accept any quote
- • Quote responses typically arrive within 24 hours
Booking Contracts
All bookings are contracts formed directly between you and the supplier. FacilitiesHire:
- • Is not a party to the booking contract
- • Does not guarantee supplier availability or performance
- • Is not responsible for disputes between customers and suppliers
- • Does not process payments or handle refunds
6. User Conduct
You agree not to:
- • Use the Service for any illegal purpose or in violation of any laws
- • Post false, misleading, or fraudulent information
- • Impersonate any person or entity
- • Scrape, harvest, or collect user data without permission
- • Interfere with or disrupt the Service or servers
- • Upload malicious code, viruses, or harmful software
- • Circumvent any access restrictions or security measures
- • Use the Service to spam or harass others
- • Post fake reviews or manipulate ratings
7. Intellectual Property
The FacilitiesHire Service, including all content, features, and functionality (excluding user-generated content), is owned by FacilitiesHire and protected by UK and international copyright, trademark, and other intellectual property laws.
You may not:
- • Copy, modify, or distribute our content without permission
- • Use our trademarks, logos, or branding without authorisation
- • Create derivative works based on our Service
By submitting content to FacilitiesHire (reviews, photos, business information), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content on our platform.
8. Limitation of Liability
To the maximum extent permitted by law:
- • FacilitiesHire provides the Service "as is" without warranties of any kind
- • We do not guarantee the accuracy, completeness, or reliability of supplier information
- • We are not liable for supplier performance, quality, or conduct
- • We are not responsible for any damages arising from your use of the Service or inability to use it
- • Our total liability shall not exceed £100 or the amount you paid us in the past 12 months, whichever is greater
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded by UK law.
9. Indemnification
You agree to indemnify, defend, and hold harmless FacilitiesHire and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- • Your use of the Service
- • Your violation of these Terms
- • Your violation of any rights of another party
- • Content you submit or post on the Service
10. Dispute Resolution
If you have a dispute with a supplier, you should attempt to resolve it directly with them. FacilitiesHire is not obligated to mediate disputes but may offer assistance at our discretion.
For disputes with FacilitiesHire itself, we encourage you to contact us first to seek an informal resolution. If that fails, disputes will be resolved through the courts of England and Wales.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising from these Terms or your use of the Service.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email (for registered users) or by posting a notice on our website. Your continued use of the Service after changes indicates acceptance of the revised Terms.
